Scobie Fine Art Terms and Conditions

Terms of Agreement
This agreement is a legal document it sets out your rights and obligations, and those of Scobie Fine Art in relation to the services we offer through this web site. By viewing and using the Scobie Fine Art web site you agree to be bound by the terms of agreement published on this site at the time of your order. You re-affirm that agreement every time you use our services.  Please note: you must be 18 years old or over to make a purchase from this web site.

Applicable Law
All sales from Scobie Fine Art are deemed to take place in England and English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and Scobie Fine Art submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Payments
Purchases from the Scobie Fine Art web site are made through PayPal™ you do not need to have an account with PayPal™ to use this service, you will however be ubject to the terms of use published on the PayPal™ web site www.paypal.co.uk To make your purchase you will be required to enter credit, debit or charge card details and you must ensure that (a) you are fully entitled to use that card at the time when you provide those details, and b) the card has sufficient funds available to cover all charges incurred on it in the course of your purchase from us. If any of the information you enter becomes incorrect or is superseded, then please email sales@scobiefineart.co.uk with the corrected information immediately.

Tax & Duties
Scobie Fine Art are not registered for VAT and therefore do not charge VAT on any of the goods or services supplied from this web site. If you want your purchase to be delivered outside the European Union, you will be responsible for paying any applicable duties and additional delivery charges.

Corrections
The descriptions of goods and services included on the Scobie Fine Art site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should be aware that the colours and appearance of images and other materials will vary slightly from the way they appear on the screen.

Copyright
The images and designs used on the Scobie Fine Art website are the property of Scobie Fine Art or their respective copyright owners and are used by Scobie Fine Art as their agents. You acknowledge that all copyright, trademarks and other intellectual property rights relating to the images on this web site are vested in Scobie Fine Art or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision regarding all the facts.

Limitation of Liability
Scobie Fine Art will not be liable to you or any third party for any direct or indirect loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.

You also agree that the liability of Scobie Fine Art under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed an amount equal to the sums paid by you.

This does not affect your statutory rights as a consumer.
In the event of consequential loss, Scobie Fine Art can only be responsible for the cost of your order.

Reasonable Control
Scobie Fine Art shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control.

Changes to this Agreement
Scobie Fine Art reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.

Severability
In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Privacy Policy
You should review the terms and conditions of our Privacy Policy by which you also agree to be bound as a condition of visiting the Site or accessing any products or services offered on the Site.

Electronic Communications
You consent to receive communications from us by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you by e-mail satisfy any legal requirement that such communications be in writing.

Delivery Times
All items are usually despatched within 10 - 14 working days of Scobie Fine Art receiving your order, however delivery times may be longer at peak times of production.

Deliveries are made between 9 and 5pm Monday to Friday, a signature will be required for receipt of your goods please note we use outside couriers and they cannot call customers for any reason.  Please email sales@scobiefineart.co.uk if you have any problems

Returns Policy Standard Items
Please note you will not receive a proof from us for Standard Items.

Any problems with any part of an order must be reported to us within 24 hours of receipt, or the following Monday morning if your order was delivered on a Saturday.

Under the United Kingdom’s Distance selling Regulations, if you have received goods and have changed your mind about purchasing them, you may return the goods for credit subject to the following conditions:


1) You inform us within seven working days of receiving the product(s).
2) You return the item(s) to us within 14 days.
3) Goods are returned in a reasonable condition and in the original packaging.

We advise all customers to sign, "NOT CHECKED" with the carrier if you have any doubts about damage upon delivery.

Returns Policy on Bespoke Items
Any bespoke items that are delivered as described and are in good condition may not be refunded. Damaged items will be exchanged free of charge. We reserve the right to charge for re-posting returned bespoke items that have been especially produced to meet your personal requirements. Bespoke items (only) will be PDF proofed and approved by the customer prior to printing, an order cannot be cancelled once the customer has approved a proofed item or production has commenced.

We advise all customers to sign, "NOT CHECKED" with the carrier if you have any doubts about damage upon delivery.

Cancellation Policy
Orders cannot be cancelled once a proof is agreed or production has commenced. Please note you will not receive a proof from us for Standard Items, only Bespoke Items will be proofed.

Vouchers
Please note vouchers expire 12 months after the date of issue.
Please contact us after this date.
